Law 74/2025 — what changed

Effective March 28, 2025. Limits automatic recognition to the second generation (children of Italian parents). Third generation and beyond now requires a judicial procedure in Italy, no longer the consular route.

Still valid via consular route:

Direct children of Italian citizens (1st gen) and grandchildren (2nd gen)

Requires judicial procedure:

Great-grandchildren and beyond (3rd+ gen) — must file in Italian court

The process

Reconstruct the lineage

Birth, marriage and death certificates for every ancestor in the direct line from the Italian emigrant to you.

Obtain US documents

Vital records from the state where each event occurred. Every state has different procedures.

Apostille

Every US document needs an apostille from the Secretary of State of the relevant state.

Certified translations

All US documents must be translated into Italian with a certification of accuracy.

Italian documents

Birth certificate of the Italian ancestor from the original comune. Certificate of non-renunciation of citizenship.

Consulate appointment

Submit the complete file to the relevant consulate via Prenot@Mi.
